TERMS AND CONDITIONS OF SALE

1. GENERAL PROVISIONS

  • 1.1. The owner of the ROGUE STITCH online store (hereinafter referred to as the Online Store) is OÜ Rogue Stitch Design (registry code: 17300380), located at Tartu maakond, Kambja vald, Uhti küla, Põdra tee 19, 61712, Estonia.

  • 1.2. These terms and conditions of sale constitute a legally binding agreement governing the purchase of goods from the Online Store between the Buyer (hereinafter referred to as the Buyer) and the Seller (the Online Store).

  • 1.3. By submitting an order, the Buyer confirms that they have read, understood, and fully agreed to these terms and conditions.

  • 1.4. Please note that the statutory right of withdrawal does not apply to purchases made by legal entities (business-to-business transactions).

2. PRODUCTS AND PRICING

  • 2.1. All prices for products sold in the Online Store are displayed next to each item. Shipping and delivery fees are not included in the item price and will be added during the checkout process.

  • 2.2. All prices displayed in the Online Store are in Euros (€) and represent the final amount due. The Seller is not registered for VAT; therefore, no value-added tax is added to the products.

  • 2.3. Delivery charges depend on the Buyer’s geographical location and the selected shipping method. The exact delivery cost will be calculated and displayed to the Buyer before the final confirmation of the order.

  • 2.4. Essential information regarding the characteristics of the goods is provided directly next to each product description in the Online Store.

  • 2.5. The Seller reserves the right to modify prices at any time. However, the price applicable to the Buyer will always be the price displayed at the exact moment the order was submitted.

3. ORDER PLACEMENT AND CONTRACT EFFECTIVENESS

  • 3.1. To place an order, the Buyer must add the desired items to the shopping cart. To finalize the purchase, the Buyer must fill in all required data fields and select their preferred shipping method. The total cost will then be displayed, which can be securely paid via bank links or other available payment solutions.

  • 3.2. The sales contract becomes legally effective once the total amount due has been successfully credited to the Online Store's bank account.

  • 3.3. If an ordered item cannot be delivered due to stock unavailability or for any other unforeseen reason, the Buyer will be notified at the earliest opportunity. A full refund (including the original shipping costs) will generally be processed within 1–2 business days. Depending on the payment provider, the refund may take up to 7 business days to clear.

4. SHIPPING AND DELIVERY

  • 4.1. The Online Store ships products to the following countries and regions: Estonia, Latvia, Lithuania, Rest of Europe, the United States and Canada. Shipping costs are borne entirely by the Buyer and are clearly indicated next to the respective shipping options.

  • 4.2. European Orders: All shipments to destinations within Europe (including the Baltic states) are dispatched directly from our fulfillment location in Latvia.

    • Domestic deliveries within Estonia: Generally arrive at the destination within 3–7 business days from the effective date of the contract.

    • Deliveries to the rest of Europe: Typically take 5–10 business days, up to a maximum of 14 calendar days.

  • 4.3. International Orders (USA & Canada): Shipments to the United States and Canada are processed promptly and generally reach the customer within 7–14 business days.

  • 4.4. Special Transport (Courier Service): For specific oversized items or at the explicit request of the Buyer, goods may be shipped via courier. In such instances, the Seller or the courier company will contact the Buyer personally to coordinate a flexible and convenient delivery time and method.

  • 4.5. In exceptional circumstances, the Online Store reserves the right to deliver goods within a period of up to 30 calendar days. If a longer delivery timeframe is explicitly stated on the website or in the order confirmation due to supply chain delays, that extended timeframe shall apply.

  • 4.6. The Online Store reserves the right to cancel the sales transaction and demand the return of the goods if, due to a technical error, the price displayed in the store was significantly below the market value of the item.

5. RIGHT OF WITHDRAWAL (RETURNS)

  • 5.1. Upon receiving the goods, consumers have a statutory right to withdraw from the online contract within 14 days without giving any reason. This right of withdrawal applies exclusively to private consumers and does not extend to corporate buyers.

  • 5.2. To qualify for a full refund under the 14-day return policy, the items must not be used in any way other than what is strictly necessary to inspect the nature, characteristics, and functionality of the goods—similar to how one would inspect an item in a physical retail store. The product must not be worn daily, must remain clean and undamaged, and all original tags, labels, and packaging must remain completely intact.

  • 5.3. If the goods show signs of wear, damage, or have been used beyond what is necessary to establish their nature and functionality, the Online Store reserves the right to reduce the refund amount in proportion to the depreciation of the product's value.

  • 5.4. To initiate a return, the Buyer must submit a formal withdrawal application (the form can be found here: withdrawal application) and email it to design@roguestitch.eu within 14 days of receiving the package.

  • 5.5. The direct costs of returning the goods are to be paid by the Buyer, unless the return is due to a mistake by the Seller (e.g., the wrong item was sent, or the product is defective).

  • 5.6. The Buyer must dispatch the return items back to the Seller within 14 days of submitting the withdrawal application, or provide definitive proof of shipment within the same period.

  • 5.7. Upon receiving and inspecting the returned goods, the Online Store will refund all payments received from the Buyer under the contract (including original shipping costs) without undue delay, and no later than 14 days from receiving the withdrawal notice.

  • 5.8. The Online Store may withhold the refund until it has received the goods back or until the Buyer has supplied proof of having sent back the goods, whichever occurs earlier.

  • 5.9. If the Buyer explicitly selected a shipping method other than the cheapest standard delivery option offered by the Online Store, the Seller is not obligated to refund the additional costs exceeding the standard delivery fee.

6. RIGHT TO FILE COMPLAINTS AND LIABILITY

  • 6.1. The Online Store is liable for any non-compliance or defects in the goods sold that existed at the time of delivery and manifest within two years from the date the goods were handed over to the Buyer. For defects appearing within the first year, it is legally presumed that the defect existed at the time of delivery; the burden of proof to rebut this assumption lies with the Online Store.

  • 6.2. Upon discovering a defect, the Buyer must notify the Online Store within two months by sending an email to design@roguestitch.eu.

  • 6.3. The Online Store shall not be held liable for defects resulting from consumer negligence or misuse (e.g., incorrect washing methods, accidents, normal wear and tear from regular use).

  • 6.4. If a product features a defect for which the Online Store is liable, the Online Store will either repair or replace the defective item. In cases where repair or replacement is impossible, the Online Store will issue a full refund of all fees associated with the sales contract.

  • 6.5. The Online Store will respond to any consumer complaint in writing or in a format allowing written reproduction within 15 days.

7. DISPUTE RESOLUTION

  • 7.1. Any complaints or claims regarding the Online Store should be directed to our customer support email at design@roguestitch.eu.

  • 7.2. If the Buyer and the Online Store are unable to resolve a dispute through mutual agreement, the Buyer has the right to appeal to the Consumer Disputes Committee (Tarbijavaidluste komisjon). The Committee holds the competence to settle disputes arising from contracts concluded between buyers and the Online Store. The review of complaints by the Committee is free of charge for the consumer.

  • 7.3. Alternatively, European Union consumers may also submit their grievances via the European Online Dispute Resolution (ODR) platform.

8. SPECIAL SECTION: GARMENT CARE INSTRUCTIONS FOR ROGUE STITCH SHIRTS

  • 8.1. Turn Inside Out: Always turn your T-shirt inside out before washing and ironing. This crucial step protects the printed graphic from friction and ensures its long-term durability.

  • 8.2. Cold Wash: Use the lowest possible water temperature. A setting of 30°C or 40°C is ideal, as indicated on the garment's care label. Avoid harsh detergents, fabric softeners, and bleaches.

  • 8.3. Skip the Tumble Dryer: High temperatures inside a tumble dryer are the primary cause of print deterioration. Air-drying or line-drying keeps the fabric soft and ensures the print remains completely intact.

  • 8.4. Ironing Guidelines: Only iron your shirt inside out on a low heat setting. Never place a hot iron directly onto the printed graphic!
